The Federal High Court in Ibadan on Monday adjourned to February 17th hearing on the N20 billion suit instituted by Sen. Iyiola Omisore against the Inspector-General of Police and the Oyo State Government for alleged malicious prosecution.
Omisore had through his counsel, Mr Herbert Adeogun, prayed the court to declare that his detention and prosecution in respect of the late Bola Ige’s murder was malicious.
Ige, a former Attorney-General and Minister of Justice, was assassinated on Dec. 23, 2001, in his Ibadan residence.
Omisore, a governorship aspirant in Osun, had challenged his prosecution, saying ``the trial was not based on the proof of evidence, but on extra judicial statements made by the prosecution witnesses.”
But at the resumed hearing on Monday, the counsel to the police, DSP Funke Fawole, and that of the Oyo State Government, Mr I.O. Tijani, pleaded for an adjournment.
Tijani told the court that he would file additional grounds to his earlier application while Fawole said she had filed her motion on notice to amend her application.
Justice Abimbola Obaseki-Adejumo,however, advised the two parties to exchange telephone numbers in order to avoid undue delay.
“You know, I don’t entertain any wastage of time and I don’t want any communication gap,” Obaseki-Adejumo said.
She fixed February 17th for the adoption of addresses and other processes.
